BREAKING: NOM Tour Tracker videographer threatened with arrest by Brian Brown, Maryland police

(Arisha just called me and then emailed this alarming news from her phone. Details are sketchy. We’ll get you more info as it comes in. — Eden James)

Just a few minutes ago (shortly before 1 p.m. ET), Brian Brown had police officers remove the Courage Campaign’s NOM Tour Tracker videographer from the Maryland NOM rally — or risk arrest.

We were told that all counter-protesters must remain across the street. When I explained to the officers –- who became enraged as I started videotaping his explanation -– that we were not counter-protesters, that we had no signs, were leading no chants and were merely documenting the rally, they said that it didn’t matter.

Maybe Brown is concerned about our work documenting the rally because, yet again, the turnout today for the NOM rally in Annapolis was extremely low (about 25 people, including staff, but I’ll get a hand-count out later), even lower than previous events on NOM’s “Summer for Marriage: One Man, One Woman” tour.

And now we see why Brian Brown is so freaked out about cameras covering his “#NOMturnoutFAIL: One Man, One Woman” tour of the country. From Augusta, Maine, to Annapolis, Maryland, NOM has consistently bombed at motivating its supporters to show up and express their support for marriage discrimination.

I just got off the phone with Arisha and the rest of our team. We’ve got footage of this as well. Apparently, NOM tried to find a different location away from the Thurgood Marshall statue (UNCONFIRMED report; waiting on confirmation).

Meanwhile, Lesbians Loves Boies points out in the comments that Brian Brown was quoted yesterday as saying the following:

“I’m Brian Brown. I’m the president of the National Organization for Marriage. They’re (NOTE: he means counter-protesters) welcome to have as many people as they like. This is America. I, you know again, we have a national bus tour in which we are going to 19 different states. We’re not organizing in just one state. We’re happy with the response. We’re not going to get into numbers.” (Brown is referring to attendance numbers at NOM’s poorly attended events).

UPDATE BY EDEN: A more detailed report on the event just came in from Arisha. See below. We’re waiting on the footage from the confrontation with the Brian Brown and the police before posting further details about what happened earlier:

The State House in Annapolis, Maryland presented Brian Brown and the NOM tour with their most challenging (and dare I say, audacious) staging location to date. Forget the fact that nobody came — we hand-counted a total of 27 people in attendance with at least 8 people that we recognized from the NOM tour staff.

Brown’s real challenge was a large statue of Supreme Court Justice Thurgood Marshall standing in front of a set of columns carved with the phrase “EQUAL JUSTICE UNDER LAW.”

Brown and crew did their best not to acknowledge the statute in front of them – opting to set their podium up to the side – but the contrast was obvious and the silence was telling.

Perhaps, that’s why Brian did not want our videographer anywhere near the scene. I haven’t seen worse staging since Senator John McCain’s infamous “green screen” during the 2008 election (but I digress).

Brown, always in spin mode, began by acknowledging the low rally turnout.

“I know it’s a hot day,” Brown started his speech. “I actually took my jacket off. I know there are parking issues, but thank you for standing up for what we all believe in.”

Rally speaker Derek McCoy (who is, coincidentally African-American) was the only person who acknowledged Marshall’s presence from the stage.

“We’ve got Thurgood Marshall here and some would say that this is not the place to have this sort of rally” McCoy said.

He continued his speech by lashing out at activist judges and elected officials who attempt to legalize same-sex marriage.

A broken chant of “let the people vote” started but never quite gained steam.

“There are folks here videotaping and blogging us [from the other side],” McCoy reminded the small audience. “And we want to let them know that we’re not going away.”

I’m not sure what exactly we did to get under NOM’s skin, but they were clearly aware of our presence.

And no Mr. McCoy, we have no plans of going away anytime soon either.

Keep checking back in with us. The longer we’re out here on the road, the more I am beginning to realize that you -– the community that has formed in the comments of this NOM Tour Tracker — are our safety net, our reason for being.

We’re going to keep the cameras rolling as long as possible; there’s no Supreme Court to stop us this time.

    Honestly, didn't expect that kind of stupidity from Brown.
    He thinks he has the right to record our guys at Albany rally, but we cannot record all the lies he spews at his pulpit?  Not gonna happen!  I talked about it from the very beginning: we need that footage, each rally, every word he says, all the evidence of NOM's bigotry and their direct involvement into passing bans on same-sex marriage in several states.  They will answer for that one day, mark my words!

    Ha! I knew my home state wouldn't stand for their shit. No way NOM'll have more than 10 native Marylanders there. Hopefully we'll have full equality soon–I've got a waiting list of people who want me to officiate at their weddings. Too bad I can't because my religious freedom is being violated along with the civil rights of every non-heterosexual in the United States.

    Sucks about the cops, though, but if I remember correctly the police are supposed to assume that the people that nonviolent (not that I'd normally use the word to apply to homophobes) protesters don't want at the protest are counterprotesters. Has to do with riot control or some such.

    was any of this recorded by any main stream media,,,, cause that would be a picture to tell a thousand words, police removing a documentary film crew, I think Arisha, put the fear of God in them because of her approach , introducing us to individuals.

    The other thing I thought of was the Kights of Colombus, (White suits), and how they were poised the other day, sort of to take up the space that the rainbow umbrelllas filled, they're using them as a buffer,

    You know what would make a great video? Some clips of the NOMos complaining about their free speech being interrupted, disrespected, etc – like they complained about in Providence. Then that juxtaposed with video or photos of him and/or the MD police threatening to arrest a photographer because (gasp) he has a camera!

    Whose free speech and association rights were being infringed upon, exactly?

    Hey, Arisha! This is Max… I was sitting next to you for most of the rally (with the glasses).

    May I suggest that the Courage Campaign obtain a protest permit for the following rallies? When allies showed up to counter-protest, they had no idea where to go (because of Brown/police threats), and the dissipation made the counter-protest look really weak. If that wouldn't work, then rainbow colored umbrellas could be supplied or something. Anything would help.

    "or risk arrest" obviously Arisha wasn't willing to do that for the cause, maybe we need to get someone in there that would, cause that's very peaceful, and would have the potential to garner some publicity for us, especially if the main line media then interviewed the person arrested, if that person had the ability to speak, we would lhave the opportunity to say something, to the public

    Bishop Jackson is a hoot. This MARYLAND resident was the lead in "protecting marriage in DC" coalition and is a walking example of true bigotry. Regardless, I'm glad to hear only 25 people showed up for their "rally" in Annapolis. Shame about the police but when you have the truth on your side (like we do) NOM and their ilk must resort to all kinds of tactics to hide their true intent. Sad but it's all coming out, slowly but surely, and this joke of "marriage tour" really reveals their lack of public support. I'm loving every minute of the coverage here on Prop8TrialTracker…thanks so much.

    Public events are just that — public. If you are not causing a disruption, they were in the wrong.

    BTW, I have been banned from posting at Louis Marinelli's blog. Just so you know. If you want to go to http://louisjmarinelli.blogspot.com, you will see that (unlike some of his supporters), I was consistently calm and factual in my demeanor.

    I think he couldn't stand that I said I'd pray for him and Brian to be delivered from their anger and insecurities, frankly.

    That really is one of the most aggravating things you can say to someone who's arguing with you, though. (a) It says "you're too deluded to see the truth so it'll take divine intervention to knock some sense into you." (b) 90% of people who get told that really don't like the gods of the people who say it. The LAST being I want anyone praying to on my "behalf," for example, is the Abrahamic god.

    I spent a good chunk of yesterday afternoon reading the comments. Your comments, especially, were fascinating — I was telling my husband last night about you & how well you write.

    I'm really not surprised you got banned. It's easy for them to dismiss people who write poorly & are rude. It's much more difficult to try to discredit someone who is obviously intelligent and has clearly put a great deal of thought into her responses. Since he couldn't really discredit you, he "had to" ban you.

    Wouldn't want lurkers getting the wrong truthful message or anything.

    Exactly. This was supposed to be a PR / Fund-raising effort for them. At the end of it all, when the books are closed, it either goes into the "Made Us Money" or "Cost Us Money" column.

    Apparently, this was Louis M's idea originally. So when they wrap it up and do the finances, and pay for the bus, the meals, the hotels, etc., does Louis and his big idea go into the "Made Money" or "Cost Money" column?

    Hmmm. No wonder Maggie G. bailed on this. Even rats know to desert when the ship is sinking.

    Dan, the whole reason I went there is that a poster called "FB" was offering to pray for people to be delivered of their "insanity" and "misunderstanding," etc. in their support for equality.

    Otherwise, I stuck strictly to factual arguments.

    Eden, I think the reason they are bombing on this tour, and why BB is freaking out so badly, is the fact that with this tour, they are finding out that their ever-increasing extremism and the escalation of their hate tactics are not playing as well with the American public as it once did. they are beginning to see the handwriting on the wall, and it is scaring the living daylights out of them. Also, as more and more people see the difference between NOM's hatred and extremist tactics, and the mostly peaceful actions we are taking, they are seeing the light and we are actually causing them to see exactly who they are harming, and they are also seeing that instead of "protecting the children" they are actually HARMING the children, and they are refusing to be a party to that.

    I'm assuming that we've got a permit to be on the South steps of the Capital building. However, NOM will be on the East steps. The reason why I say this is because Lori from the Stonewall Democrats was telling other FB users to be at the south steps because if we go to the east steps to protest we'll be arrested.

    these last two video's are their spin to their choir, what we want to hear, is not their spin, and definetly not our own, but we want the main stream media's spin,,,,

    what I find interesting is that they don't say their numbers are low because their supporters fear coming out because they were threatened by us. they are saying thos threat only are encouraging them more to ask their supporters to come out.

    each side is claiming the other as evil expressing hate, the Catholic Church is definetly cashing in on this bus ride, they already got enough info to portray us as evil, shouting them down,

    One man, one woman because that's how God created marriage at the beginning of time.

    We Christians need to stand up for our rights (i.e. the right to discriminate based on our interpretation of the Bible).

    No matter what they or anyone else says, it's a choice – and an icky one! Any group who says otherwise is clearly wrapped up in the pro-gay agenda!

    First they'll legalize gay "marriage," then it will be polygamy, then incest and bestiality… cats and dogs living together, etc…

    Ask any experienced protester – if you plan on taking a risky action, one that could result in arrest, there is a lot of prep work that needs to be done. You have to have a contact person pre-arranged, bail money in place, etc. (and it never hurts to have a lawyer on stand-by during the time the arrest and jail processing is expected to happen).

    I've been arrested before and believe me, once you're in there (jail) you want to be SURE that there is someone who knows you're there and is actively working on getting you released, because you are cut off from the outside world.

    Fiona–I just got finished reading the thread on little louie's blog…the comments by "fb" and "katie" underscore that there is no rational basis for nom's opposition. Their supporters base all of their arguments on either the bible or their own distaste for gays. You did a fine job of exposing their clay feet, but unfortunately talking to walls doesn't make them fall down. However, other readers were undoubtedly heartened & enlightened by your insightful comments and GREAT links (I visited & read each one; lots of fun in there!)…keep up the good work, even if you can't return to little louie's place. :)

    Supporters of nuptials for gays and lesbians clashed with members of the National Organization for Marriage at the Rhode Island State House in Providence on Sunday, July 18.

    After making stops in Maine and New Hampshire last week, the New Jersey-based organization brought their "Summer for Marriage Tour" to the Ocean State. The message: marriage should remain a union between only a man and a woman.

    Other stops on the 19 state, 23 city tour include Indiana, Ohio, Maryland, Washington, New York and New Jersey.

    Republican Gubernatorial candidate Victor Moffitt and roughly 100 others listened to NOM President Brian Brown; Christopher Plante, director of the organization’s Rhode Island chapter; attorney Scott Spear; Dr. Jennifer Roback-Morse, and the Rev. John Codega of St. Brendan Church in East Providence, who represented the Roman Catholic Diocese of Providence.

    More than 150 LGBT activists and allies, wearing red shirts and waving rainbow flags and banners, marched up the State House’s stairs and stood as the NOM speakers addressed their supporters.

    "Get your hate out of our state," they chanted, along with "Homophobia has got to go."

    As Brown spoke, Capitol Police ushered some activists away after they shouted in his face. Brown claimed marriage supporters were the real bigots.

    "They’re the face of intolerance," he said. "They think its okay to deprive us of our civil rights," noting LGBT activists were trying to silence marriage opponents.

    As the protesters’ chants became louder and more impassioned, NOM supporters grew louder, shouting "One man, one woman."

    "Same-sex marriage will redefine parenthood," said Roback-Morse, explaining children belonged with a mother and a father, not parents of the same-sex.

    Roback-Morse founded the Ruth Institute, which describes itself as "an inter-faith non-profit organization using the best of academic research and legal analysis to promote the Judeo-Christian view of marriage." After the rally ended, Plante said he believes marriage supporters had damaged their own cause.

    "It makes our case," Plante said. "We can’t say ’one man, one woman’ without being shouted down."

    Brown blasted the protesters in a blog post on NOM’s Web site titled "Gay Activists embarrass themselves in Providence."

    "The hatred was palpable," wrote Brown. "It was an embarrassment to their cause – I only hope the word gets out, so people can see how nuts they were. These activists simply embarrassed themselves and their cause today. Mocking religion. Mocking children. I mean, what kind of adult goes up to a 7-year-old child and sneers, "Mommy raising you to be a good little bigot?"

    For the state’s LGBT activists, the NOM counter-protest represented a metaphorical breaking point. Rhode Island remains the only New England state where lawmakers have not approved marriage for same-sex couples. And Gov. Don Carcieri has repeatedly thwarted any attempts to advance this and other LGBT-specific issues.

    "We wanted to make sure that they saw us," explained Susan Heroux of Queer Action of RI.

    Heroux added NOM supporters were able to get their message across to their followers, but she noted the demonstrators did nothing wrong.

    "People expressed themselves in a respectful manner," added Heroux.

    NOM’s next local event is their second annual Celebrate Marriage and Family Day at the Aldrich Mansion in Warwick on Aug. 15. As EDGE previously reported, the event will feature keynote speaker Glenn Stanton from Focus on the Family.

The Courage Campaign isn't in the business or organizing counter-protests or rallies while we're on the ground for the bus tour – we're leaving that work to the highly competent lgbt organizations on the ground to decide what messages and tactics work best in their state.     I have an idea. I don't know if it is any good or not, but how about setting up preemptive protests and rallies. For example, if the NoM tour is supposed to stop in Raleigh, NC on August 10, set up a counter protest/rally in Raleigh for August 9, 10, and 11.

    I have been trying for sevarl days now to try and get some support for a rally of support for our brothers and sisters on August 15th here in Seattle….as yet I have ZERO interest and ZERO responces from the LGBT community leaders here.
    I've called, left voice mail, sent emaul, posted contact info and such on my Facebook page, as well as sent out FaceBook announcements to any and everyone I could think of.
    Anyone have any suggestions on what else to try?
    I can't believe that after such a heated fight during last years fight over Ref 71 here in this state that others can't see how important this is.
    I'm feeling very sad and very defeated today :-(

    Jackson is the lead plaintiff in the series of court cases challenging marriage equality in DC. The most recent result is last week's DC Court of Appeals decision in Jackson v. D.C. Board of Elections & Ethics, in which he and his supporters got shot down again.

    If you go to DC, you can do that, but with what BZ and I have seen on the forms, you will want to contact your judge or whoever first, before you file for it, and according to their site, they are running 8-10 weeks behind on performing the weddings once the licenses are issued.

    @Arisha, thanks for clarifying, CC's position re documenting, kbut letting organizations on the ground decide what action is best.

    As was said on previous threads, there are organizations on the ground, who left contact info on this site, who have the experience that Kathleen is talking about, re how to get arrested peacefully, (even informing police prior to the event of you intientions), permits, and also I would assume arrangemens for bail etc.

    There are people willing to do that, if any organziation in any state wants to pursue that approach, enough said.

    It's pretty awesome that we have people "on the ground," and "on the front lines" (pardon the military metaphors), keeping track of this. It really is necessary in order to expose the falsity in the NOM advocate's claims of being victims, and documenting just how deluded they are about their mainstream popularity.
    The latest picture of their rally at the Thurgood Marshall "Equal Justice Under The Law" statue is priceless. Perhaps NOM's goal is to have Brian Brown eventually speak to a rally of literally "one man and one woman."

    Another thing about arrests and arrests at political rallies as well. Some towns and cities require the collection of DNA from all persons arrested for some non-violent crimes. As reported in the New York Times, many departments keep this DNA on file for later use and do not destroy them should the person not be charged with a crime and merely released.

    Probably about $1500 total. My car is very economical gas wise, and I would have no problem sleeping in the car. And depending upon the cameras I get I should be able to get several out of that. Of course, that is a rough guesstimate and does not include any bail or other unexpected expenses.

    That, Colin, is one of the odd paradoxes in this peculiar worldview that the NOM types keep pushing.

    First they insist that they're the majority and will of the people and popular vote and so on and so forth. "There are lots and lots of us and so we should be able to do whatever we want. That's what democracy is all about!"

    And then, in the same breath, they insist that they're some kind of persecuted minority: struggling martyrs who are being targeted by a sinister and powerful cabal of liberals intent on pushing a "gay agenda".

    So which is it, Brian? Moral majority or maligned minority?

    I'd say the answer lies somewhere between the two:

    No one has the right to determine or judge what another person must sacrifice for anyone or any cause. I'm guessing you were just caught up by the very strong emotions surrounding NOM et al, but let's not start attacking our own people.

    As one of my Aikido senseis once said, when asked about a potential conflict between "love your enemies" and "defending oneself with physical force". He said, "it is good to love your enemies. You must be ALIVE to love your enemies."

    For most of us, losing one's job very quickly puts "being alive" at risk, not only ourselves but those who depend on us.

    I find a few things very interesting about the NOM-a-polloza bus tour. First, and quiet obviously (and why they don't want it recorded) no one seems to care. The "rally" in Annapolis has a handful of people, some of them looked like they wandered in looking for a free bottle of water. I'd be embarrassed for this organization if they weren't so vile.

    Second, this weird guy from the bus, Brian…uhm, stop blaming the weather for your lack of turn out and start blaming your message. Most people have enough common sense not to be associated with what is plainly a ridiculously hateful group. They have better ways of spending their day. And I don't care if you take off your jacket or strip down to your Scooby-Doo underwear, be happy the protestors are there, they outnumber the people who have actually come to listen to your sad, trite idiocy.

    When I was a little kid in Catholic school, Sister Anne always used to say that when you're pointing a finger at someone, you always have three coming back at yourself. Brian, when you bellow so fervantly, "This is the face of intollerance," or "they're not taking away our civil rights," I can't help but chuckle (and believe me I'm not alone) because I think of Sister Anne's words. Most people don't know Sister Anne but they also know you're really talking about yourself, your organization, and your cause.

    And lastly, I would put out a bucket somewhere, Brian, you know, to collect for gas money. This tour has got to be costing you guys some bucks and as any good tour manager would tell you, you aren't bringing in enough to cover the costs. Maybe it's time to just tour a few small towns in the south where you'll get a bigger audience because they've been indoctrinated a little more to your liking and there is less to do so they're more apt to brave the heat and come out for a free bottle of water or a free pen or some other neat give-away.

    You guys need to have multiple cameras running. Have the primary camera (the one that was ordered to stop in this case), a second camera filming the first getting shut down, a third filming the others. Have a string of cameras.

    Have so many cameras going that you can show what TRULY goes on to stop the truth from being disseminated. It's tricky, but it's fun!

    you have misread my posts, I only made a statement, you implied the judgement,

    I am not judging anyones sacrifice or telling anyone what to do, I'm simply stating, there are people trained in doing this, if people chose to try that approach,

    my posts have nothing to do with "defending oneself with physical force" in fact I do not advocate for myself or anyone else any type of physical confrontation.

    that is why I made the suggestion to contact people who can provide training in peaceful resistance, it's been done many times you don't resist arrest, there's no physical fight involved.

    What I am advocating is for people to decide their own comfort levels around such a risky venture, and act accordingly, thankfully some people have already said they would not involve themselves in this approach, that clarifies things,

    people on this site, also have differing views, and all I'm saying is maybe we could plut some of that energy to use.

    I for one would like to see a full video of Brian's whole speach uinterrupted, just let him make his speach, and put it on you tube,

    Sadly, this is my view of why Prop 8 passed in California in the first place. It's difficult to get people motivated early on, when it is most effective and the easiest to stop.

    But everybody gets all riled up after some law or regulation is passed, when it is costly and difficult to undo. I've seen it first hand and via the news as well. I wish I knew the answer.

    I'm African American and heterosexual, and I despise people like McCoy and any other AA who would attend these kinds of rallies because I find it difficult to understand how/why an AA could join up with any group to deprive anyone else of his/her constitutional rights. I grew up under segregation in this country, so I know exactly how it feels to be considered a second class citizen by others in your own country. McCoy needs to take a refresher course on the history of African Americans in this country. He and others like him are an embarrassment to me and many other African Americans.

    Slightly amusing… I just went to check out http://louisjmarinelli.blogspot.com and see what he is on about. When I opened the page, I noticed he had 21 followers. I read some things (that annoyed me) and was skimming the comments (most of which are from people on the Equality side of the issue) then followed a link off the page to watch a video. On returning to the blog, I happened to notice that the number of followers was down to 14.

    So the support there is following the same pattern as support for NOM at their rallies. At this rate, by the end of their tour, they are going to be claiming that the Equality protesters are there to support NOM because they will be the only people in attendance.

    I don't think "everybody" does it. EqualityMaine uses images of real people and real families, people who we all know and are part of the struggle here in Maine.

    I would think that with such a groundswell of support all across the country, you'd expect NOM to be able to get a few real families and supporters. He can spin it all he wants, but it's part of the whole trend of these people wanting to take away our rights while hiding behind the anonymous protection of victimhood. Bleck.

    It is nothing like removing cameras from the courtroom. This is removing cameras from an open, public park….

    I look forward to seeing the footage and seeing Brian’s involvement. I believe it against federal law to remove someone acting as the press or to remove an observer from a public rally for video taping.

    They want it one sided. They can’t control the great, uninterrupted video footage you guys are creating. If they can’t edit it, they can’t make themselves look good.

    I really can't wait for these people to come to Washington DC. I'm getting a group of people together to go out with me to DC to counter-protest.

Plenty of straight people believe in equal rights for the LGBT community. But they seem to have a VERY hard time finding a member of the LGBT community that does not want equal rights.

    But, seriously. How many people are going to be there to "Welcome" NOM in DC?

    Why didn't you sue the police for violating your First Amendment rights (e.g., freedom of the press)? Even if just a blog, what you are doing still counts as journalism. Sue NOM too if they had misrepresented what you were doing to the police or file criminal charges against them – lying to the police is a serious crime.

    If you win enough, you could fund your operation for some time and all the news organizations would back you – it sets a bad precedent if someone can shut down the press because they don't like what the news will be.

    Shrill anti-gay advocacy group NOM was quick to post a video of people standing in front of an anti-gay activist and claiming they were "intimidating" and "bullying" her. We need to immediately post a video showing unrepentant homophobe Brown intimidating and bullying the pro-equality videographer. Freedom of the Press does not just apply to those promoting the anti-gay agenda.

    People aren't showing up, because they are guilt-ridden. They know in their hearts that homophobia is evil and wrong. So, they feel anxious and guilt-ridden and they avoid these negative feelings by not showing up. Perhaps they would feel better if they did the right thing and rejected NOM's Hate Tour and hate agenda.

    I actually noticed the NOM tour tracker videographer get threatened. I was forced to stand across the street since I had a sign and the cop made him stand with me, but he only did so for a moment before returning to the rally. The only people at the NOM rally, other than the protesters, were complete radicals wearing shirts that compared gay people to "worse than animals" claiming there source was "the zoo". It scares me that there are people like this in the state that I call home.

    Unfortunately, things have been going wrong in Maryland over the last few months with respect to the right to videotape in public places. In Baltimore alone, there have been several incidents of people getting arrested under Maryland's wiretapping laws for videotaping police. It's absurd, but it's not limited to NOM rallies.

    It is NOT illegal to photograph people in public spaces. The supreme court ruled that there can be no expectation of privacy in a public place.

    It is illegal in some states to record people in PRIVATE places without their consent. But If you're in public, you're fair game.
